Terms of Service

Welcome to Kabeer Design ("we", "us", "our"). By accessing kabeerdesign.com (the "Site"), purchasing our design services, or downloading and using our software including LayerFlow (the "Apps"), you agree to these Terms of Service.

1. Using our Site & services

You must be at least 18 years old, or have the consent of a parent or guardian, to purchase from us. You agree to provide accurate account and billing information and to keep it up to date.

2. Design services

• Project scope, deliverables, revisions and timelines are defined per order or quote.
• Work begins once payment (or the agreed deposit) is received and the brief is confirmed.
• Ownership of final deliverables transfers to you upon full payment. Until then, all work remains our property.
• We may display completed work in our portfolio unless you request otherwise in writing.

3. Apps & licenses

Use of LayerFlow and other Apps is governed by the End User License Agreement. Licenses are issued as keys in the format LF-XXXX-XXXX-XXXX and may be activated on up to three (3) devices per license.

4. Payments

Prices are listed in USD and processed securely via Stripe and PayPal. Subscriptions renew automatically until cancelled. You authorise us to charge your chosen payment method for all fees incurred.

5. Acceptable use

You agree not to misuse the Site or Apps, including by attempting to copy, resell, reverse-engineer, or circumvent licensing of our software, or by submitting unlawful or infringing material in design briefs.

6. Limitation of liability

The Site, services and Apps are provided "as is". To the maximum extent permitted by law, we are not liable for indirect or consequential losses. Our total liability for any claim is limited to the amount you paid us for the relevant service or license.

7. Changes & governing law

We may update these Terms from time to time; continued use constitutes acceptance. These Terms are governed by the laws of [Your Country/State]. Questions? Email md@kabeerdesign.com.

Privacy Policy

We respect your privacy and only collect what we need to run our business. This policy explains what we collect, why, and your rights.

Information we collect

• Account & order data: name, email, billing details, and project briefs you submit.
• App & license data: license key, device identifiers and activation counts used to enforce the 3-device limit.
• Usage data: cookies and analytics about how you use the Site, to improve it.

How we use it

• To deliver services, process payments, and issue and validate license keys.
• To provide support and respond to your enquiries.
• To send important account, order and (if you opt in) marketing emails.

Sharing & processors

We never sell your data. We share it only with trusted processors needed to operate, such as our host (Hostinger), payment providers (Stripe, PayPal) and email/SMTP services. Each handles your data under their own privacy terms.

Your rights

You may request access to, correction of, or deletion of your personal data at any time by emailing md@kabeerdesign.com. You can unsubscribe from marketing at any time via the link in our emails.

Data security & retention

We use SSL/HTTPS, secure hosting and access controls to protect your data, and retain it only as long as needed for the purposes above or as required by law.

Refund Policy

Apps & software

We offer a 14-day money-back guarantee on app purchases (Starter, Pro and Lifetime). If LayerFlow isn't right for you, email us within 14 days of purchase for a full refund. Upon refund, the associated license key is deactivated.

Subscriptions

You can cancel a monthly subscription anytime from your account; cancellation stops future renewals. We don't provide partial refunds for the current billing period unless required by law.

Design services

• Because design work is custom and begins on payment, fees become non-refundable once work has started.
• If you cancel before work begins, you're entitled to a refund less any non-recoverable costs.
• Revisions are handled per the package terms; refunds are not a substitute for the revision process.

How to request a refund

Email md@kabeerdesign.com or open a ticket in the Help Center with your order number. Approved refunds are returned to your original payment method within 5–10 business days.

End User License Agreement (EULA)

This EULA is a legal agreement between you and Kabeer Design for the use of LayerFlow and other Apps. By installing or using the software, you accept this agreement.

1. License grant

We grant you a non-exclusive, non-transferable (except as stated for Lifetime licenses) license to install and use the software for your personal or business use, subject to your plan and these terms.

2. Device limit

Each license key may be active on up to three (3) devices simultaneously. Activation and device counts are validated by our licensing server. You may deactivate a device from your account to free a slot.

3. Restrictions

• You may not share, resell or sublicense your key (except transferring a Lifetime license as permitted).
• You may not reverse-engineer, decompile, or attempt to bypass license validation or the device limit.
• You may not use the software for unlawful purposes.

4. Updates & ownership

Updates are provided per your plan (while subscribed, or for life on Lifetime). All intellectual property in the software remains owned by Kabeer Design. This license does not transfer ownership of the software to you.

5. Termination

This license ends automatically if you breach its terms, including misuse of keys or circumvention of the device limit, after which you must stop using and delete the software.

6. Disclaimer

The software is provided "as is" without warranties of any kind. To the extent permitted by law, Kabeer Design is not liable for any damages arising from its use.
